Terms of Service

1. Agreement to Terms

By accessing or using Alonso Velocity Lab ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by DGB Innovations LLC ("DGB Innovations," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Alonso Velocity Lab is a baseball recruiting and athlete development platform for high school athletes and their families. The Service includes a Coach CRM, AI-assisted recruiting email generation, offer tracking, NCAA timeline tools, performance tracking, and access to Dylan Alonso's in-app training program (Tier 2 subscribers only).

3. Eligibility

You must be at least 13 years old to use the Service. Users between 13 and 17 must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

4. Subscription and Billing

• The Service is offered on a subscription basis. A 7-day free trial is available to new accounts.
• After the trial period, your chosen subscription tier will be billed automatically on a recurring basis until cancelled.
• All payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis.
• Subscriptions can be cancelled at any time from your account settings. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for partial periods.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of NCAA, NAIA, or other governing body regulations
• Submit false, misleading, or fabricated athletic information to coaches or programs
• Attempt to reverse-engineer, scrape, or exploit any part of the Service
• Share your account credentials with any other person
• Use the AI email generation feature to send spam or unsolicited mass communications

6. AI-Generated Content

The Service uses Anthropic's AI to generate recruiting email drafts. You are solely responsible for reviewing, editing, and sending any AI-generated content. DGB Innovations makes no warranty that AI-generated emails are accurate, appropriate, or effective. You must not send AI-generated emails that contain false information about your athletic credentials or academic record.

7. Intellectual Property

The Service, including its software, design, and training content created by Dylan Alonso, is owned by DGB Innovations LLC and its licensors. You retain ownership of the data you enter (your athletic stats, coach contacts, recruiting notes). You grant DGB Innovations a limited license to use your data to provide and improve the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN RECRUITMENT OFFERS, ATHLETIC SCHOLARSHIPS, OR ANY SPECIFIC ATHLETIC OUTCOME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DGB INNOVATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OF OR INABILITY TO USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (III) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT SHALL DGB INNOVATIONS LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO DGB INNOVATIONS LLC IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Testimonials and Results Disclosure

Any testimonials, success stories, or recruiting outcomes displayed on the Service reflect genuine experiences of individual users. Results vary and are not guaranteed. Recruiting outcomes depend on many factors outside our control, including the user's athletic ability, academic record, and the decisions of college coaches and programs.

In compliance with FTC 16 C.F.R. Part 255: results shown are not typical and individual results will vary.

11. DMCA / Copyright

DGB Innovations LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, please send a notice to drew@dgbinnovations.com with: (1) identification of the copyrighted work; (2) identification of the infringing material; (3) your contact information; (4) a statement of good faith belief; and (5) a statement of accuracy under penalty of perjury.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Hall County or Forsyth County, Georgia, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide 14 days' notice of material changes by email or in-app notification. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
